Data Privacy Declaration / Information Obligations in accordance with Art. 13 GDPR
General information
Protecting your personal data is very important to InVitaGO GmbH, Stresemannallee 4b, 41460 Neuss, (hereinafter referred to as the "provider"). The provider processes personal data on the basis of statutory regulations, and above all in accordance with the principles of Articles 5 and 6 of the General Data Protection Regulation (GDPR).
The controller (client) responsible for data processing is the provider.

Scope and purpose of data processing
a) In relation to SARS-Cov-2 testing or other contractual fulfillment:
In relation to SARS-CoV-2 testing, we collect personal data (name, address, date of birth, etc.) as well as health data, such as the individual's social security number, in order to fulfill the test contract / diagnostic contract concluded with us, and for billing purposes, for instance with social insurance agencies, the German Association of Statutory Health Insurance Physicians, public sector clients and external billing providers. As a diagnostic laboratory, we may also collect further personal data in certain circumstances and cases. This data is processed only by professional technicians, including external lab physicians commissioned to test swabs, as well as external billing service providers. All of the above data is subject to either professional secrecy or a non-disclosure obligation.
b) Data from a registration for testing (registration form) or other forms:
If you want to commission us or contact us, several different parts of our homepage offer the option of transmitting your personal data (such as your name, e-mail, etc.) to us using a contact form. The data you enter into the contact form will be processed by our service providers for the purpose of sending us your inquiry (via e-mail or as an appointment in the schedule database). The data you enter into the contact form is used only for the purpose of submitting your inquiry for processing.
Providing your personal data is always voluntary. However, a test order or parts of an order cannot be completed if you do not provide your personal data. If we are missing any personal data which would prevent the test order or parts of the order to be carried out, we will inform you of this in a timely fashion.

Legal bases of data processing
b) When carrying out a test order, e-mail correspondence and filling out forms (test registration, contact form, etc.):
Data is processed either on the basis of your consent (Article 6 para. 1 lit a) GDPR or Article 9 para. 1 lit a) GDPR), or because processing your data is necessary in order to fulfill the test order / diagnostic agreement (Article 6 para. 1 lit b) GDPR or Article 9 para. 1 lit h) GDPR). Furthermore, we are subject to certain legal obligations (such as reporting obligations) which require that we process your personal data (Article 6 para. 1 lit c) GDPR and Article 9 para. 1 lit g) GDPR).
b) When you visit our homepage:
We are required to process your data in order to pursue our legitimate interests (in the secure operation of our homepage) (Article 6 para. 1 lit f) GDPR). If we carry out data processing based on your consent, you can revoke that consent at any time without providing grounds. Please direct your revocation to (datenschutz@invitago.eu), and please include at least a brief description of the extent to which you are revoking your consent. The revocation will not affect the legality of data processing carried out up to this time.

Transmitting data to third parties
Your data is never transmitted to third parties without your consent. The exception to this rule are transmissions which are absolutely necessary to fulfill and process the test order, or which we are legally obligated to make. Possible recipients of the data, for instance, include referring physicians and/or health agencies.

Duration of storage
We store your data when absolutely necessary for the duration of the business relationship, and thereafter for as long as specified under the law. Once you revoke your consent with future effect, your personal data will be deleted unless it is subject to statutory retention periods or if the personal data is required in order to maintain evidence under statutes of limitation.

Data security
We take all necessary technical and organizational measures to protect your personal data against unauthorized access, loss and/or misuse. Your data is processed in a secure and state of the art operating environment.

Your rights
Right to information:
You can request information from us regarding whether and to what extent we process your personal data.
Right to submit complaints:
You have the right to submit complaints to the responsible data protection authority (https://www.bfdi.bund.de/DE/Infothek/Anschriften_Links/anschriften_links-node.html) or to another supervisory authority within the EU.
Right to object:
If we process your data as part of our legitimate interests, you can submit an objection to further processing if you have an interest in keeping your data confidential which outweighs our own interests.
Right to rectification and correction:
If we accidentally process your data in an incomplete or incorrect manner, you have the right to request that we rectify or complete your data.
Right to restrict processing:
You can request that we restrict processing of your personal data if you dispute the correctness of this data. This restriction applies
1. For as long as necessary for us to review the data to determine if it is correct,
2. If our data processing is illegal, but you do not want the data to be deleted, and
3. If the data is no longer required for the intended purpose, but you still require the data to assert or defend against legal claims, or you exercise your right to object.
Right to deletion:
You can request the deletion of your personal data if we are processing it illegally, or if you revoke your consent to processing.

Exercising your rights will not have any effect on the mutual requirements to fulfill contractual obligations. If we require additional information to confirm your identity in order for you to exercise your rights, we will inform you of this.

Future amendments to this Data Privacy Declaration
The current Data Privacy Declaration has been prepared based on the current valid legal situation. If this legal situation changes, we expressly reserve the right to make amendments to the Data Privacy Declaration.

Exclusion of liability
If the homepage www.invitago.eu refers to third party content, we have no influence over said content or the personal data that may be processed by said third party pages. We accept no liability for third-party content. Likewise, we provide no guarantee and accept no liability if third parties process your personal data illegally on pages to which we link. Third parties to whose content we refer are not considered our processors in the sense of the GDPR.
